American Certification Institute (known hereinafter as ACI) is an international professional certification institute registered as a Limited Liability Corporation (LLC) in the State of Delaware , USA . ACI has made great progress by combining advanced American educational theory and management methods consistent with the professional education situation in China . This has improved intercultural communication between the American and Chinese people since it began to do business in China . 美国认证协会（ American Certification Institute 简称 ACI ）是经美国特拉华州州政府合法注册的一家从事国际职业资格培训认证的有限责任公司。 ACI 自进入中国以来，将先进的国际职业教育理念及管理办法与国内实际情况相结合，取得了令人瞩目的进展，推动和促进了中美民间的文化交流。
Another organization has been doing business under the name of ACI in China, and this organization has encroached upon ACI's intellectual property rights both in the US and China. 针对近来国内有个别机构利用 ACI 的名义在全国各地进行商业活动，严重侵犯了 ACI 的知识产权，美国认证主席特此声明如下：
Firstly, shortly after commencing operations in China , ACI authorized Beijing Five Star Huan Yu to represent ACI in China , but ACI terminated its agreement with Beijing Five Star Huan Yu on March 19 th , 2004 for Beijing Five Star Huan Yu's default on several agreement provisions. Therefore, Beijing Five Star Huan Yu's right to conduct business under the name of ACI was null and void as of March 19 th , 2004 . ACI will not bear any responsibility for any education or training activities conducted by Beijing Five-Star Huan Yu International Culture Exchange Center under the name of ACI or to represent ACI in any way effective March 19, 2004 . Any such illegal acts by Beijing Five-Star Huan Yu International Culture Exchange Center is subject to legal action in the US and China by ACI. 一• ACI 进入中国初期，曾授权北京五星环宇国际文化交流中心（以下简称五星环宇）暨聂荣先生作为 ACI 的合作伙伴，在合作过程中，发现该中心未能很好地履行合同职责，经常给 ACI 带来负面影响。为此， ACI 经研究决定于 2004 年 3 月 19 日，正式解除了与五星环宇的合作。自此，五星环宇已无任何权利再以美国认证协会名义开展各项职业资格认证工作。对于 2004 年 3 月 19 日以后北京五星环宇国际文化交流中心在非法代理下以美国认证协会名义下所从事的任何教育或培训活动，美国认证协会将不承担任何责任，同时美国认证协会也将会在美国和中国追究此类非法活动的法律责任。 ACI 的合法官方网站是： www.amcertinst.org 和 www.amcertinst.org.cn 。
Subsequently, Mr. Nie Rong, President of Beijing Five Star HuanYu, registered a company named ACI in California , USA with the chief executive officer of Rong Nie on April 26 th , 2004 by filing a false claim that he lives in California , USA . Meanwhile he maintains a Chinese website at www.aci.org.cn and an English website at www.usa-aci.org for his OWN ACI accordingly. The type of business of this “ACI” is “Culture Exchange” but not “Professional Certifications”. This business, known hereinafter as ACI California, has seriously encroached on ACI's intellectual property rights. Mr. Nie Rong has also caused to be published many insulting articles both on the internet and newspapers of China to attack Dr. LeRoy H. Graw. These defamatory and libelous articles are actionable in a court of law.
二• 北京五星环宇国际文化交流中心法人代表聂荣先生，于 2004 年 4 月 26 日在美国加利福尼亚州以其自己为法人注册成立了所谓的 “ 美国认证协会 ” ，并为他自己的 ACI 建立了相应的中英文网站（中文网址： www.aci.org.cn ; 英文网址为： www.usa-aci.org ）。该公司的注册是通过聂荣先生自己声称住在加利福尼亚州而得以注册成功的，且其公司业务类型仅为文化交流而非职业资格认证。到目前为止，该公司已严重侵犯了我协会的知识产权，本人已授权美国本土的律师通过法律手段，提请当地州政府在密切注视和高度警惕的同时，要严厉追究聂荣的法律责任。同时，针对出现在中国国内一些网站和报纸上的多篇有关诋毁诽谤本人的文章，本人将在适当的时候，追究责任人告其诽谤罪。
Thirdly, all the information of ACI in Delaware can be checked both at the Secretary of State, State of Delaware , USA and the U.S. Commercial Service websites at: http://www.mycorporation.com/allservices/order/cert.htm and http://www.buyusa.gov/china/zh/fuse.html?exp_cat=6599&exp_pid=274 respectively. From last year on, there have been several organizations, like International Talent Exchange Center of Personnel Bureau of Hebei Province, Pudong Talent Development Center of Shanghai Personnel Bureau, Inner Mongolia Brand Association, etc., which all terminated the agreements with so called “ACI China Headquarters” registered under the name of Nie Rong after they identified the fact. And now these organizations mentioned above have become important partners of ACI ( Delaware ).
三• 关于美国认证协会的相关信息，敬请国内所有的教育培训机构和有志报考 ACI 认证项目的考生，通过美国特拉华州政府网站和美国驻华使馆商务处进行查询。我协会信息在两者的官方网站的位置分别为： http://www.mycorporation.com/allservices/order/cert.htm 和 http://www.buyusa.gov/china/zh/fuse.html?exp_cat=6599&exp_pid=274 。 自去年至今，已先后有河北人事厅国际人才交流中心、上海人事局浦东人才开发中心、内蒙古品牌协会等单位和机构，通过严格认真的查询核对，均已先后解除了与聂荣名下的所谓 “ACI 中国总部 ” 的合作。上述机构现均已成为本协会的重要合作伙伴。
Fourthly, Gaoyang is ACI's strategic partner in China , and is the exclusive agent for ACI”s programs as follows: Certified Human Resource Manager (CHRM), Certified Marketing Manager (CMM), Certified International Banking Manager (CIBM) and Certified International Professional Manager (CIPM) respectively.
